CHALET DES CIMES

SELF-CATERING TERMS & CONDITIONS

These terms and conditions, together with any other information and agreements made either in writing or verbally, form the basis of your contract with us. 

DEFINTIONS

‘We’, ‘our’ etc refers to us.  We are Mike & Sue Brinsley, also referred to as ‘Peak Leisure’.  ‘You’ and ‘the Client’ refers to members of the booked party.  ‘Party Leader’ refers to the person who has signed the booking form and paid any monies due.

CONFIRMED BOOKINGS & DEPOSITS

Throughout the booking, all communications with us must be through the Party Leader.  Your contract with Peak Leisure starts when the Party Leader has paid the deposit of 25% of the total cost and returned a completed and signed Booking Form to us.  The deposit must be received by us no later than 4 days after you confirm your reservation.  Full payment of the balance is due 10 weeks before the arrival date, or immediately if the booking is made within this period.  If payment is not received by the due date, we reserve the right to treat this as a cancellation and to levy any cancellation charges as appropriate.  Any charges levied by our bank for foreign transfers or cheque payments are at the Client’s cost. 

The Party Leader will be liable for full payment of deposits and balances for everyone on the original and any subsequent booking forms, plus any written alterations.  Payment can be made by direct bank transfer, or cheque, and the contract will only exist once the payment for the deposit has been cleared.

CANCELLATION BY THE CLIENT

Cancellation of the whole booking must be confirmed in writing by the Party Leader.  Letters sent by post and emails are acceptable.  Cancellation charges will be applied as follows:

CANCELLATION BY PEAK LEISURE

In the highly unlikely event that we have to cancel a confirmed booking, any payments you have made to us will be refunded in full.  We regret, however, that we cannot accept responsibility or liability to pay compensation where we are prevented from fulfilling our obligations by circumstances amounting to ‘Force Majeure’.  This includes, but is not limited to, war, riot, civil action, actual or threatened terrorist activity, strikes, natural disasters, fire, industrial disputes, technical problems, adverse weather conditions, natural or nuclear disasters, government action or other events beyond our control.

We reserve the right to cancel any booking where the information provided by the Party Leader or other Clients in the party is deemed to be inaccurate.

ALTERATIONS BY THE CLIENT

We will be happy to accept name changes or cancellations within a party.  You are also welcome to add names up to the maximum occupancy of 8/9 people, subject to prior agreement with us.  These alterations must be made by the Party Leader, and will be free-of-charge.

SAFETY OF PROPERTY

Our chalet insurance does not cover theft without forced entry, and you will be liable for any losses suffered under these circumstances, whether the stolen items belong to you or us.  You must therefore ensure that doors are locked and windows closed and secured when you are away from the chalet.

DAMAGE AND NUISANCE

We reserve the right to recover from you the cost of repairs or replacements following any damage or loss caused by anyone in your party.  A damage deposit of £400 is required on arrival.  This may be paid by cash, cheque.  If you decline to pay the damage deposit, this will be treated as a cancellation on your part, the normal cancellation terms will apply, and you will be unable to take occupation of the property. If the property or any items are damaged or if items are missing at the final inspection, or if the chalet is left in an extremely dirty condition, your deposit will be returned to you minus the appropriate amount to cover replacement, repair (other than for minor damage), or additional cleaning efforts.  We also reserve the right to recover from you any amounts due in excess of the damage deposit already paid.  If we need time to obtain a quote for such replacements or repairs, we will retain the damage deposit until the final costs have been confirmed. 

We will advise you of any existing damage of which we are aware when you arrive.  You must notify us of any damage you find in the chalet within 24 hours of arrival, otherwise we will assume that you were responsible for that damage.

Clients are responsible for their behaviour during their stay at the chalet.  If any Client acts in a manner which we reasonably deem to be extreme, or detrimental to Peak Leisure, we reserve the right to terminate their holiday without written notice or liability and to eject them from the chalet with immediate effect.  This includes causing significant damage, significant anti-social behaviour and illegal activities.

PEAK LEISURE LIABILITY

We do not accept responsibility for our Clients’ actions, and will not be liable for any claims made against them either by other Clients or third parties.

In the event that Peak Leisure is found liable on any basis whatsoever our maximum liability to the Client is limited to the invoiced cost of the booking in question, and does not extend to additional costs incurred in the taking of the holiday, such as travel costs.

INSURANCE

You should be adequately insured for your holiday, and we strongly advise that you ensure your insurance includes cover for cancellation and personal injury.  It is a condition of your booking with us, however, that you are insured for damage to the chalet and its contents, and we ask therefore that you provide us with written details of your policy before starting your holiday with us.

ARRIVALS AND DEPARTURES

The chalet will be ready for you from 4.00pm on your day of arrival, and you will have access to it from this time.  You will be required to vacate your rooms and leave the chalet by 10.00am on your day of departure.

NO-SMOKING POLICY

Smoking is permitted on the balcony only, and ashtrays are provided.  Clients are requested to use these and not to throw cigarette stubs etc on the ground below, as they will create an unsightly mess when the snow melts.  Smoking in any form, including pipes and cigars, is not allowed anywhere inside the chalet.  This rule will be strictly enforced.  If it is discovered that anyone has smoked at any time in the chalet, a charge of £100 will be made to cover the cost of cleaning, etc.

CHILDREN

Whilst we make every effort to ensure safety in the chalet, you must accept responsibility for the behaviour and welfare of any children in your party.

PETS

Pets are not accepted in the chalet, unless with prior written agreement with us.  This rule will be strictly enforced, and if it is discovered that any Client has brought a pet into the chalet without our permission, we reserve the right to require either the whole party or the individual Client to leave the chalet immediately, without compensation.

ACCURACY OF INFORMATION

We do our best to ensure that the information we provide on our website, in emails and on the telephone is accurate and it is always given in good faith.  However, some descriptions are by nature subjective, and in addition we cannot guarantee that nothing will change.  For example weather conditions and facilities provided by external sources are changeable and outside our control.  The Party Leader should therefore check with us in advance regarding any feature that is of particular importance to your holiday.
